Paso Gran Fundo 2024

Waiver and Release of all Claims, Indemnification and Hold Harmless

In consideration of the acceptance of my request to participate in Paso Gran Fundo 2024 Cycling Camp, I hereby waive, release, and discharge any and all claims for damages for death, personal injury, or property damage which I may have, or which may hereafter accrue to me as a result of participation in said event. This waiver and release is intended to discharge in advance Bob Temmerman, Laura Hill Temmerman, Letitia Davis, and Shawn Johnson and any employees or independent contractors thereof, even though liability may arise out of negligence or carelessness on the part of the persons or entities mentioned above. I further understand that serious accidents occasionally occur during bicycle riding, and that participants in bicycles rides occasionally sustain mortal or serious personal injuries, and/or property damage, as a consequence thereof. I also understand that bicycles may occasionally be damaged during transport. I have read the ride announcement above including a description of the ride and some of the hazards I may encounter during the ride.

I hereby agree to indemnify and hold harmless all of the parties and entities mentioned above, for any and all damages, costs, claims, liability, judgments or expenses, including attorneys’ fees incurred in the prosecution of this indemnification agreement or which may arise directly or indirectly as a result of my conduct or the conduct of others during or in relation to this event. I further agree that this release and waiver shall also apply to all unknown and unanticipated claims and hereby waive the benefits of the California Civil Code Section 1542, which provides “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

It is further understood and agreed that this waiver, release and assumption of risk is binding on my heirs and assigns.  I have read this document and I understand that it is a release of all claims. I understand that I assume all risks inherent in this bicycling event and in particular those described in the ride announcement.
